Standard Terms & Conditions of Trade

1. Engagement
- POWERWORX Aust Pty Ltd (“the Contractor”) warrants that it holds all necessary licences, insurances, skills and experience required to perform the services and will carry out all work in a professional and competent manner.
- If an event occurs outside the Contractor’s reasonable control that prevents completion of the works within the agreed timeframe, the Contractor will notify the Customer as soon as practicable and provide an updated estimated completion time.
- All materials and equipment supplied by the Contractor will be new (unless otherwise stated) and fit for their intended purpose.
- Where the Customer does not specify particular brands, models or specifications, the Contractor will supply materials deemed suitable for the works.
- Any requested changes to supplied materials may incur additional costs.
- Any variation to the agreed scope of works requested by the Customer will be treated as a variation and may:
- incur additional charges; or
- require a revised quotation at the Contractor’s discretion.
2. Acceptance & Cancellation
- Acceptance of a quotation or engagement of the Contractor constitutes acceptance of these Terms & Conditions.
- If the Customer cancels works after accepting a quotation, the Customer agrees to pay all reasonable costs incurred by the Contractor up to the time of cancellation, including but not limited to:
- materials ordered
- restocking fees
- freight charges
- permits and approvals
- labour and preparation costs
3. Quotes, Invoices & Payment
- Quotations are valid for 30 days unless otherwise stated.
- The Customer agrees to pay all invoices in accordance with the terms specified on the quotation or invoice.
- The Contractor may issue progress invoices for work completed where delays occur due to:
- lack of access
- delays caused by the Customer
- incomplete site readiness
- Payments may be made via:
- electronic bank transfer
- approved credit card
- cash (by agreement)
- Overdue accounts may incur interest at a reasonable rate, calculated daily, on outstanding amounts until paid.
- The Customer is not entitled to withhold or offset payment unless agreed in writing by the Contractor.
- Where a defect is reported, the Contractor will investigate within a reasonable timeframe.
- All invoices remain payable while the investigation is ongoing.
4. Works & Site Conditions
- The Customer must provide safe, clear and unrestricted access to the worksite.
- The Contractor reserves the right to charge additional costs where delays occur due to:
- restricted access
- site conditions
- third-party delays
- circumstances outside the Contractor’s control
- Standard working hours are:
Monday to Friday, 7:30am – 5:00pm
(unless otherwise agreed)
- The Contractor will:
- follow all relevant safety standards
- ensure all workers are appropriately trained and supervised
- supply and use all required safety equipment
- The Contractor maintains current Public Liability Insurance and will provide proof upon reasonable request.
5. Warranties
- All materials supplied are covered by the manufacturer’s warranty.
- The Contractor provides a LIFETIME workmanship warranty of from completion of works.
- Warranty does not apply where defects arise from:
- misuse or damage
- unauthorised alterations
- external factors beyond the Contractor’s control
- Warranty claims will be assessed and rectified within a reasonable timeframe.
6. Limitation of Liability
- To the extent permitted by law, the Contractor is not liable for:
- indirect or consequential loss
- loss of business, profit or opportunity
- The Contractor’s liability is limited to:
- repair or replacement of defective work; or
- the value of the services provided
7. General
- These Terms & Conditions are governed by the laws of Victoria, Australia.
